The case was brought against Circle Marketing Ltd as a result of its failure to pay a fine of £130,000, the associated administrative charge or comply with a refund sanction imposed by the Tribunal of 27 November 2014. The Tribunal upheld a further two breaches of the Code in relation to the Level 2 provider’s non-compliance with the sanctions imposed and its failure to make payment of the administrative charge. The Tribunal imposed a formal reprimand, and a prohibition on the provider from providing, or having any involvement in, any premium rate service for a period of three years, starting from the date of publication of the decision, or until payment of the fine and the original and instant administrative charges whichever is the later.
