Regulator fines Mobtech UG £200,000 after it charged consumers without consent

The Phone-paid Services Authority (PSA) has fined and banned Mobtech UG from the market after investigating its ‘Secret Sales Codes’ service. The PSA received a total of 92 complaints from consumers. 

The complainants variously alleged that they hadn’t signed up for the service, with accounts including: “I never signed up for this ‘service’. I have no idea how they got my mobile number.” 

The Tribunal found that Mobtech committed three breaches of the PSA Code of Practice. The breaches were around consent to charge, being misleading and failing to provide information to the PSA during its investigation. 

The Tribunal formally reprimanded Mobtech, fined it £200,000 and banned it from the market for five years. It also ordered Mobtech to refund any consumers who claim a refund.
