PSA bans director of company that ran misleading directory enquiry service from the market

The Phone-paid Services Authority (PSA) has banned Devon Kelly from the premium rate services market for five years.

Kelly is the director and sole shareholder of Madlenka Limited, a company which was sanctioned in June 2019 after it misled consumers into calling premium, 118 numbers and failed to adequately inform them of the cost of the calls. The PSA took enforcement action against this company after receiving 11 complaints from consumers, which resulted in a number of sanctions being imposed including a £250,000 fine.

Following this initial adjudication, the company did not pay the fine or comply with other sanctions, and so was banned from the market for at least five years.

The Tribunal has now barred Kelly from the premium rate services market, after the Tribunal found that Kelly was knowingly involved in a series of serious breaches of the PSA’s Code.
