The service operated under the brand name “RecordCall” and was charged at 60 pence per minute. The PSA received 20 complaints in relation to the service. Complainants variously alleged that they were unaware of the nature of the service or the service charges. The Tribunal upheld seven breaches of the Code, in relation to a failure to fully and clearly inform consumers of all the key information, a failure to provide clear pricing information, misleading consumers, a failure to register the service as required, and failures to comply with three of the Special conditions in relation to ICSS. The Tribunal imposed a formal reprimand, a fine of £850,000, a requirement that the provider obtain and implement compliance advice and a bar on access to the service until the provider obtains and implements compliance advice. The Tribunal also imposed a requirement that the Level 2 provider refund all consumers who claim a refund. |
